“When drivers of large trucks, buses and hazardous materials take their eyes off the road for even a few seconds, the outcome can be deadly,” said Transportation Secretary Ray LaHood. “I hope that this rule will save lives by helping commercial drivers stay laser-focused on safety at all times while behind the wheel.”. The final rule prohibits commercial drivers from using a hand-held mobile telephone while operating a commercial truck or bus. Drivers who violate the restriction will face federal civil penalties of up to $2,750 for each offense and disqualification from operating a commercial motor vehicle for multiple offenses. Additionally, states will suspend a driver’s commercial driver’s license (CDL) after two or more serious traffic violations. Commercial truck and bus companies that allow their drivers to use hand-held cell phones while driving will face a maximum penalty of $11,000. Approximately four million commercial drivers could be affected by this final rule.

“This final rule represents a giant leap for safety,” said FMCSA Administrator Anne S. “It’s just too dangerous for drivers to use a hand-held cell phone while operating a commercial vehicle. Drivers must keep their eyes on the road, hands on the wheel and head in the game when operating on our roads. Lives are at stake.” I just called FMCSA and asked this question.

I know hand held cell phones are banned under this new rule. My question is are voice activated cell phones legal for CDL drivers to use while driving? The answer was yes the driver may only use a compliant mobile telephone, such as a hands free mobile phone, to conduct a voice communication. FYI if you are ticketed for this offense it is considered a serious offense.

Distracted driving is a problem in the New Orleans area and all throughout the country. Most people probably agree that safe driving requires concentration on the road and not on other things like eating, playing with the radio or talking on a cellular phone. But, just because people understand this does not mean that everyone acts accordingly. When a truck driver is at issue, distractions are particularly dangerous. This is because commercial trucks are so much bigger than passenger vehicles; thus, truck accidents tend to cause devastating damage when smaller vehicles are also involved. Given the dangers of a distracted truck driver on the road, what is the law about truckers using cell phones while they are driving?

In 2014, the Federal Motor Carrier Safety Administration, in conjunction with another federal agency, published rules that prohibit interstate truck drivers from using hand-held mobile phones while they are driving. Drivers can use a hands-free phone, but it must truly be hands-free, meaning that the driver doesn't even have to press a single button to dial. In addition to prohibiting talking on a hand-held phone, the rules also cover texting. This means that commercial truck drivers must abstain not only from sending a text message, but they also cannot read a text message that they receive while driving.

A is just too high of a risk to take when it comes to distracted driving. Therefore, the federal rules are stringent in prohibiting truck drivers from using hand-held cell phones. If a driver ignores the rules and gets in an accident, injured victims can use the trucker's cell phone use to show that the trucker, and maybe even the truck company, were liable for the damages.
